Procedural Safeguards

The Procedural Safeguards Notice sets forth the procedural rights that students with disabilities and their parents have under the 2004 Reauthorization of the Individuals with Disabilities Education Act (IDEA).  The Notice is to be provided by local school districts to parents of children with disabilities or adult students with disabilities at specified times during the school year. 

                                                                                 

The Notice comes from a model form created by the federal Office of Special Education Programs (OSEP).  It has been modified by the Division of Exceptional Children Services to reflect Kentucky law in this area.  The Notice closely tracks language in the IDEA regulations. However, where appropriate, it has been written to be more user-friendly.
